Permits
You must be 21 years of age and posses a Valid Pistol License to purchase any pistol or pistol type of ammunition. You must be 18 years of age and posses a Valid Driver’s License to purchase any Rifle, Long Gun or Rile type of ammunition. You are also required to pass a Federal Form 4473 NICS Background Check to purchase firearms.
It is the customers’ responsibility to make sure the firearm they are purchasing is legal to own or posses in their state. Check your local and state laws before you make a purchase. Please see our returns policy for more information about returns.
Prices
Except when a fixed price is quoted by Top Gun Tactical Weapons the price of goods are subject to change without notice and the prices will be those in effect at the time of shipment and/or delivery of goods.
Orders
All orders placed are subject to acceptance by Top Gun Tactical Weapons. Top Gun Tactical Weapons reserves the right to refuse any order. All special or custom orders are to be paid in full at the time of ordering and must be picked up within 10 days of notice that your order has arrived.
All orders placed with Top Gun Tactical Weapons can be cancelled by the customer prior to shipping. Once an order has shipped it cannot be cancelled. Most orders will be proceed within 24 hours. Orders that ship from the manufacturer vary and may take up to 5 to 7 days to process. This processing time is out of Top Gun Tactical Weapons control and we ask that you please be patient.
Returns
All sales of firearms, ammunition, apparel, optics, electronic items, special or custom orders, and serial numbered items such as lower receivers are FINAL and returns are NOT ACCEPTED. There will be a 45% restocking fee for cancelled orders. The percentage is based off the price of the item. Accessories returned within 14 days from original purchase date will be in the form of store credit only and must be unopened or sealed in the manufactures original package as well as include the original sales receipt.
Terms of Payment
Unless payment terms are approved by Top Gun Tactical Weapons in advance, all orders shall be either cash upon delivery or paid in advance of shipment.
Taxes
New York residents are subjected to NYS sales tax NO EXCEPTIONS. Any tax imposed by any governmental or taxing authority becomes payable by customer at the time of checkout.
Shipping
Unless otherwise agreed in writing by Top Gun Tactical Weapons all goods sold shall be delivered to customers billing address. We will not ship to a P.O. BOX. and the customer bears all risk of loss following delivery of goods to the delivering carrier. Delivery dates are estimated based upon conditions prevailing at the date of an order and are subject to change based upon conditions existing at the time of scheduled delivery or any subsequent change in conditions. Top Gun Tactical Weapons will have no liability for such changes, but will provide reasonable notice of any changes to the customer. If Top Gun Tactical Weapons offers free shipping, Top Gun Tactical Weapons will designate the means of transportation. If the customer requests a different more expensive means of shipping, the customer will pay the shipping cost involved. The cost of any special packing or special handling as a result of customer’s requirements shall be added to the amount of the goods ordered. If the shipment of goods is postponed or delayed by customer for any reason, the customer agrees to reimburse Top Gun Tactical Weapons for any handling and storage costs and other additional expenses resulting there from.
Delivery and Inspection
Any claims for shortages or damages suffered to Goods in transit are the sole responsibility of customer and shall be submitted by customer directly to the carrier. Shortages or damages must be acknowledged and signed for at the time of delivery. TRANSFERRING DEALER SHALL PROMPTLY INSPECT EACH FIREARMS SHIPMENT TO DETERMINE IF ANY FIREARMS ARE DAMAGED OR MISSING FROM SHIPMENT. If any shipment is not complete, Dealer shall immediately report the serial number of any firearm to Top Gun in writing. Dealer shall fully cooperate with any investigation by Top and any law enforcement agency relating any such missing firearms.
Warranties & Disclaimers
Customer understands that Top Gun Tactical Weapons is not the manufacturer of the products purchased by customer and warranties are only those of the manufacturer, not seller or its affiliates. Customer expressly waives any claim that it may have against the seller or its affiliates based upon any product liability or its safety. Customer further agrees that seller makes no representations or assurances out of the use of these products. Any damage, injuries or death arising from any of these products is the sole responsibility of the customer. It is the user’s responsibility to keep their firearm safe and secure.
If a firearm is defective or deemed unsafe it will fall under the manufacturer’s warranty.
